These General Terms and Conditions ("Terms and Conditions") are applicable to any use of the website KindSeed.com ("Website"), to any services available on the Website and to any and all offers, orders and agreements connected therewith ("Services").

The Terms and Conditions shall be applicable in addition to the Terms of Use, available on the Website. In case of any inconsistency between the Terms and Conditions and the Terms of Use, the Terms and Conditions shall prevail.


Article 1 - General
  1. You acknowledge and guarantee that by using the Services you have reached the age of 19 years.
  2. You undertake to duly comply with all instructions stated on the Website by, among other things, providing true, accurate, current and complete information about yourself.
  3. You undertake to update information about yourself within ten (10) days of any changes.

Article 2 - No unlawful or prohibited use
You undertake not to use the Services for illegal purposes or contrary to these Terms and Conditions and the Terms of Use or any, if such is the case, other applicable terms.

Article 3 - Restriction/termination
KindSeed.com reserves the right, in its sole discretion, to terminate your access to all or any part of the Services at any time for any reason whatsoever without prior notice or liability. Cause for such termination shall include, but not be limited to, (a) breaches or violations of the Terms and Conditions and/or Terms of Use, (b) requests by law enforcement, (c) unexpected technical or security issues or problems, and (d) extended periods of inactivity.

Article 4 - Credit Card Use
If you are paying with a credit card, you agree that the card is valid and you are the cardholder. Third party credit card payments will not be accepted. All credit card orders will receive a telephone call from the billing department and may be asked to provide a photo-copied Drivers Licence as well as front and back of the credit card accompanied with the cardholder's signature. If your order was determined by KindSeed.com to be fraudulent, all information will be forwarded to the appropriate authorities for investigation.

Article 5 - Offers/ Agreement
All offers made by KindSeed.com are without commitment until you have received the acknowledge of acceptance from KindSeed.com, by which the agreement is concluded. You are aware of the technical steps leading to the conclusion of the agreement, whether the agreement shall be archived and is accessible, and the languages in which the agreement can be drawn up. KindSeed.com is not obliged to supply information to you with respect to the above prior to the conclusion of the agreement.

Article 6 - Delivery and shipping info
The time of delivery has a maximum of thirty days from the time of billing. In case KindSeed.com is not able to deliver the product(s) within thirty days, KindSeed.com shall inform you immediately in writing (e-mail, fax or letter) in which case you are entitled to terminate the agreement by notifying such in writing (e-mail, fax or letter) to KindSeed.com.

Article 7 - Guaranteed Delivery
KindSeed.com guarantees delivery worldwide. If shipping information is incorrect, kindseed.com will wait until the product or package has been returned before re-shipping.

Article 8 - Liability
  1. Kind Seed guarantees all products sold at kindseed.com are authentic and all seeds are guaranteed up to 90% germination rate when the Kind Seed suggested germination steps are followed.
  2. By ordering products from this website, you assume all liability and release kindseed.com and any kindseed.com affiliates from any liability whatsoever.
  3. The marijuana seeds offered at kindseed.com are intended for medicinal and research purposes only; kind seed will not be held liable for any other intended use .



Article 9 - Liability

  1. KindSeed.com's liability is limited to the warranty stated in article 9. In any event the liability of KindSeed.com resulting from the delivery of defective products will be limited to direct damages up to the amount of the price stipulated for the products concerned. Liability for indirect damages is excluded unless the damages are due to KindSeed.com's wilful intent or gross negligence.
  2. Without prejudice to article 10 section 1, KindSeed.com will not be liable in the event that the defect has been fully or partially caused by any incorrect, improper, careless or incompetent use and/of if you have made any modifications to the products.
  3. You hereby agree to indemnify and hold harmless KindSeed.com, its subsidiaries, affiliates, directors, agents or any other party involved in creating, producing, or delivering of the Website or the Services against any and all claims of third parties due to or arising out of your use of the Services and/or your violation of the Terms and Conditions.

Article 10 - Evidence
The administration of KindSeed.com counts as, unless the contrary is proven, conclusive evidence of the orders which are given by you, your payments to KindSeed.com and the Services. You acknowledge that electronic communication can be used in evidence.

Article 11 - Customs
KindSeed.com does not guarantee that customs does not confiscate the products ordered by you. If such is the case KindSeed.com will not refund any payments to you, but will upon receipt of proof of confiscation, resend the product.

Article 12 - Payment

  2. In the event of non-payment for whatever reason, you will automatically be in default and will owe the legal interest on the total amount invoiced from the date due and all expenses of the collection of payments incurred by KindSeed.com.

Article 13 - Miscellaneous
  1. KindSeed.com reserves the right to modify these Terms and Conditions at any time. Such modifications shall be effective immediately upon posting of the modified Terms and Conditions.
  2. These Terms constitute the entire agreement of the parties and supersede any and all prior and contemporaneous agreements of the parties relating to the subject matter. If any provision of these Terms is determined to be invalid or unenforceable, then such invalidity or unenforceability shall not have any effect on any other provision of these Terms, all of which shall remain in full force and effect.
  3. These Terms are governed by the laws of the United Kingdom. The district court in Victoria, London has the exclusive jurisdiction regarding any and all disputes relating to these Terms.
