Cannabis Laws in New Jersey
Adult-use cannabis is legal in New Jersey for adults 21+, and a separate medical program also operates. The New Jersey Cannabis Regulatory Commission oversees both under CREAMMA, the state’s adult-use law, enacted as P.L.2021, c.16. CREAMMA section C.24:6I-33 defines a consumer as a person 21 years of age or older, and personal use by anyone under 21 is not authorized. Anyone who wants to buy weed seeds in New Jersey should first read the home grow rule below.
The medical program came first, created by Senate Bill 119 in 2010. Voters then approved adult use through Public Question 1 in 2020, and the Legislature passed Assembly Bill 21 in 2021. The law is codified starting at C.24:6I-31 of the New Jersey statutes. The National Conference of State Legislatures tracks these laws and lists New Jersey among the states with adult-use and retail sales. NCSL describes Assembly Bill 21 as legalizing certain personal use while removing marijuana as a schedule I drug. Since the November 2020 election, the state constitution provides that cannabis refers to the regulated form of the plant and marijuana refers to the unregulated form of the plant.
Adults 21+ may possess up to 6 ounces of cannabis and cannabis products. Licensed retailers work under a separate per-sale limit of 1 ounce of usable cannabis, which caps a single sale and does not change the possession limit. N.J.S.A. 2C:35-10, as amended by P.L.2021, c.19, classifies possession of more than 6 ounces as a fourth degree crime.
Retail sales of cannabis and cannabis products carry New Jersey sales tax of 6.625%. The commission’s FAQ lists product categories such as dried flower, concentrated oils, resin, vape formulas, tinctures and topicals, with availability varying by dispensary. The commission does not set prices, which come from the business that sells the products. Under CREAMMA, revenue from adult-use sales goes into the CREAMM Fund, and the Governor and the Legislature make the appropriations.
Home grow is not allowed in New Jersey. CREAMMA instead sets up business license classes, including the Class 1 Cannabis Cultivator license. Every cannabis seed in New Jersey sold here stays stored in its pack, and that includes a souvenir marijuana seed in New Jersey kept on a shelf.
The commission explains these rules in its New Jersey Cannabis Regulatory Commission general FAQ. The full CREAMMA text is on nj.gov as the New Jersey CREAMMA statute. Under the federal hemp definition in 7 U.S.C. 1639o, the rule that excludes some viable seeds from hemp takes effect Dec 11, 2026. Certain other provisions, including the synthetic cannabinoid exclusion, take effect Nov 12, 2026. The Congressional Research Service summarizes the change in its report IF13136, last updated Sept 28, 2026. The amendment came through P.L. 119-37, and P.L. 119-103 delayed portions of it. The amended text is published on uscode.house.gov. General information only. Check current New Jersey law. Last verified October 2026.
