New York Home Grow Rules at a Glance

New York legalized adult-use cannabis through the Marihuana Regulation and Taxation Act (MRTA), signed in 2021, and licensed adult-use retail sales began on December 29, 2022. According to the New York Office of Cannabis Management (OCM), adults 21+ have been allowed to grow cannabis at home since June 26, 2024. The main rules:

• Plant limits: up to 3 mature and 3 immature plants per adult, and no more than 6 mature and 6 immature plants per private residence, even if three or more adults live there (OCM, NY Penal Law §222.15).
• Where: only in, or on the grounds of, your private residence. OCM’s FAQ notes you can’t grow in a hotel, motel or other temporary accommodation.
• Security: plants must be kept in a secure place, not accessible to anyone under 21, and not plainly visible from public view.
• Odor: OCM asks growers to take reasonable steps so odor doesn’t become a nuisance to neighbors, such as a carbon filter indoors.
• No sales: it is illegal to sell, trade or barter homegrown cannabis.
• No flammable materials: OCM prohibits their use in home cultivation.
• Local rules: Penal Law §222.15 lets counties, towns, cities and villages reasonably regulate home cultivation, but not completely prohibit it.
• Home storage: adults may lawfully possess up to five pounds of cannabis at their private residence or on its grounds, and must take reasonable steps to keep it in a secured place out of reach of anyone under 21 (Penal Law §222.15(5)).

Are Cannabis Seeds Legal to Buy in New York?

New York’s OCM says adults 21+ can buy home-grow seeds from licensed retailers, microbusinesses or RODs. Separately, under federal law, Kind Seed Co sells seeds as hemp seeds under the 2018 Farm Bill definition. A new federal hemp definition starts in two stages, on November 12 and December 11, 2026 (see our FAQ). Congress could move that date again.

New York’s official guidance addresses seeds directly. OCM’s home cultivation FAQ says adults 21+ can buy seeds or immature plants for adult-use home cultivation from a licensed adult-use retailer, microbusiness or registered organization with dispensing (ROD), and suggests contacting the licensee first to confirm availability. OCM’s home cultivation regulations also require seeds kept for home growing to be stored in a secure location at your residence, out of reach of anyone under 21.

Which Weed Seeds Grow Best in New York?

New York has humid summers, short upstate seasons and tight city space. Check your local frost history before an outdoor run, and keep the plant limits in mind. Growing indoors avoids relying on a short outdoor window.

Autoflower seeds. Autoflower seeds start flowering based on age rather than a change in daily light hours. They stay compact, which suits short upstate seasons, closets and small tents.

Feminized seeds. Feminized THC seeds grow photoperiod plants that need a light change, commonly 12 hours on and 12 off, to start flowering. They suit indoor growers who control their own light.

Regular seeds. Regular seeds can grow into male or female plants. They’re for growers who want to breed or pick keeper plants from a wider range.

Yes. Our stock is already in New York, so orders to NYC and the rest of the state ship in-state. Every order goes by USPS in a plain envelope, with nothing on the outside to show what’s inside. Weed Seeds Usa White Label seeds are packed in vials, and branded seeds stay in their original breeder packs.

We aim to hand orders to USPS on the next business day. Most customers receive their order within a few days to a week, though some deliveries take up to two weeks and holiday periods can run longer. Once USPS has the package, delivery timing is in its hands. If tracking shows a package as delivered but it hasn’t arrived, email support@kindseed.com and we’ll send you a copy of your invoice and the steps to open a USPS investigation. Let us know right away, because lost packages aren’t replaced if you wait more than two weeks to tell us.

Seeds are viable when shipped. We test our stock regularly and store it in a humidity- and temperature-controlled environment, so your seeds sit in steady conditions right up until they ship.

Weed Seeds Usa White Label seeds carry a 3-month germination guarantee. To make a claim, email support. Claims are limited to one per paid order and apply to orders of 100 seeds or fewer, and you’ll need to follow our recommended method and document your process.
