Can medical patients grow cannabis at home in Florida
Florida has hundreds of thousands of qualified medical marijuana patients, one of the largest programs in the country. Many of them have asked the same question: can I grow my own? As of late October 2026 the answer is still no. Florida law does not allow medical patients, caregivers or anyone else to grow cannabis at home, and growing even one plant can lead to a felony charge. This post explains why, what bills have tried to change it and what patients can do instead. It is legal background only, not legal advice.
The short answer
Florida’s medical program, created by Amendment 2 in 2016 and written into section 381.986 of the Florida Statutes, gives patients access only through licensed Medical Marijuana Treatment Centers, often called MMTCs. These companies grow, process and sell under state licenses. The statute does not include any patient cultivation right. Outside that statute, Florida’s drug laws treat growing cannabis as manufacturing a controlled substance.
| Question | Florida answer as of late Oct 2026 |
|---|---|
| Can patients grow at home? | No |
| Can caregivers grow for patients? | No |
| Can adults 21 and older grow? | No, adult use is not legal |
| Is any plant count allowed? | No |
| Where can patients buy? | Licensed treatment centers only |
Penalties
Cultivation in Florida is treated seriously. Growing cannabis is generally charged as a third degree felony, and larger grows can bring trafficking charges with mandatory minimum sentences. A medical card is not a defense to a cultivation charge. Police can also treat grow equipment, lights and seeds intended for planting as evidence. Penalties depend on the facts, so anyone facing a charge should speak with a Florida attorney.
Bills that tried to change it
Florida lawmakers have filed patient home grow bills in several sessions. In 2026, Senate Bill 776 would have let qualified patients grow a small number of plants at home with registration. It died in the Senate Health Policy Committee on March 13, 2026 without a floor vote, like earlier versions.
Voters also had a chance at broader change. Amendment 3 in 2024 would have legalized adult use. It earned about 56 percent of the vote, short of the 60 percent Florida requires for constitutional amendments, so it failed. Notably, that amendment did not include home grow either. It would only have allowed licensed companies to sell to adults.
What did change in 2026
The 2026 session passed a law, effective July 1, 2026, that adjusted several parts of the medical program, including the definition of low THC cannabis, physician course rules and rulemaking deadlines for the Office of Medical Marijuana Use. None of it created a home grow right. We break those changes down in our Florida 2026 program changes post.
Why Florida has resisted home grow
Supporters of the current system point to product testing, tracking and labeling at licensed treatment centers. Opponents of home grow in the legislature have raised concerns about diversion, child safety and enforcement. Patient groups argue cost is the bigger issue, since treatment center prices can be high and a card must be renewed. That debate is likely to continue in the 2027 session, but nothing has passed as of late October 2026.

What patients can do instead
- Shop around. Florida has many treatment center brands with different prices and product lines. Compare menus online before you visit.
- Watch for discounts. Many centers offer loyalty programs and discounts for veterans or low income patients.
- Keep your card current. Renew your physician certification and state ID card on time so you do not lose access.
- Follow legislation. Contact your state legislators if home grow matters to you. Bills are filed most years.
- Do not grow. Growing in Florida carries real legal risk regardless of medical status.
Hemp is not a loophole
Some people ask whether growing hemp at home is a way around the ban. Florida requires a license from the Department of Agriculture and Consumer Services to grow hemp, and hemp plants must stay under the federal THC limit on a dry weight basis. Home hemp grows without a license are not legal, and a plant that tests over the limit is treated as cannabis.
A note on seeds and equipment
Owning grow lights, tents or fans is legal in Florida, since they have many uses. Problems start when equipment is used to grow cannabis. Keep that line in mind before buying anything, and remember that a grow setup found with plants is often used as evidence of intent.
Federal context
The April 2026 Justice Department order placed state licensed medical marijuana in Schedule III. That covers treatment center products made under Florida’s program. It does not create any home grow right, and federal law still treats unlicensed cultivation as illegal.
Where home grow is legal
Most adult use states allow adults 21 and older to grow a few plants at home, and a few medical only states such as Oklahoma allow patient grows. Our guide to the legal requirements for growing weed plants in your state lists the current rules by state, and our roundup of the most recent states to legalize recreational marijuana shows how quickly the map has changed.

Seeds in Florida
Cannabis seeds are sold online in many places, but planting them in Florida is illegal. Our Florida seeds page explains that Kind Seed Co seeds are sold as souvenirs and for genetic preservation in states where cultivation is not legal. Grow legally and responsibly
Home cultivation is only legal in some states, and each state sets its own plant limits, locking rules and rules about whether plants can be visible from a public place. You must be 21 or older to buy seeds from Kind Seed Co, and you should grow only where your state and city allow it. Check your state rules in our guide to the legal requirements for growing weed plants in your state before you plant. Federal treatment of cannabis seeds is also changing, so read our December 11 2026 seed rule explainer before you order. Keep plants and harvested flower locked away from children, pets and visitors, and never drive after using cannabis. This article is general information. It is not legal advice and it is not medical advice.
