Ohio Home Grow Rules at a Glance

Ohio voters approved Issue 2 on November 7, 2023, legalizing cannabis for adults 21 and over, and the Ohio Division of Cannabis Control says non-medical sales began on August 6, 2024. Home grow is now governed by Ohio Revised Code §3796.04, enacted by Senate Bill 56 and effective March 20, 2026. Under that section, an adult-use consumer (21+) may grow homegrown marijuana plants at their primary residence if:

• Not more than 6 plants are cultivated or grown by each adult-use consumer.
• Not more than 12 plants are cultivated or grown at a single residence.
• Growing takes place only within a secured closet, room, greenhouse or other enclosed area, in or on the grounds of the residence, that prevents access by anyone under 21 and is not visible by normal unaided vision from a public space.
• The residence is not a family child care home, a halfway house or similar licensed facility, or a rental whose rental agreement prohibits growing.

The same section does not authorize growing anywhere except your primary residence, selling or profiting from homegrown marijuana, growing on behalf of another person, or processing homegrown marijuana by hydrocarbon-based extraction. It gives no authority to anyone under 21.

The Ohio Division of Cannabis Control regulates both the medical and non-medical cannabis programs under Ohio Revised Code Chapter 3796.

Where Can I Buy Marijuana Seeds in Ohio?

Federal law and Ohio law treat cannabis seeds differently. Under federal law, Kind Seed Co sells seeds as hemp seeds under the 2018 Farm Bill definition. A new federal hemp definition starts in two stages, on November 12 and December 11, 2026 (see our FAQ). Ohio has its own rules, which can be stricter: Ohio’s hemp definition (Ohio Revised Code 928.01) and its adult-use cannabis law (Chapter 3796) apply separately. Which Weed Seeds Grow Best in Ohio?

Most of Ohio has a humid continental climate, and late-summer humidity raises mold pressure on dense, maturing flowers. Northern inland counties tend to see frost earlier, while right along Lake Erie the water usually holds off the first fall frost a little longer. Autoflower seeds. Autoflower seeds flower based on age rather than day length, stay compact and have a short vegetative stage. Outdoors, that shorter cycle is one way to plan a harvest before the first fall frost, which tends to come earlier in northern inland Ohio counties. Mold-resistant strains. Our mold-resistant strains are a good place to start for humid Ohio late summers.

Feminized seeds. Feminized THC seeds grow photoperiod plants that need a light change, commonly 12 hours on and 12 off, to start flowering. They suit indoor growers who control their light and want to decide when plants flip. Outdoors, they need a full season to finish, so check your local frost history first.

Regular seeds. Regular seeds can grow into male or female plants. They’re for growers who want to breed or pick keeper plants. Plan around the 6-plant-per-adult limit when deciding how many to start.

We aim to hand orders to USPS on the next business day. Most customers receive their order within a few days to a week, though some deliveries take up to two weeks and holiday periods can run longer. If tracking shows a package as delivered but it hasn’t arrived, email support@kindseed.com and we’ll send you a copy of your invoice and the steps to open a USPS investigation. Let us know right away, because lost packages aren’t replaced if you wait more than two weeks to tell us.

Seeds vs Dispensary Products in Ohio

We sell seeds for home growers, and only seeds. We don’t sell finished cannabis products or live plants, and we are not a licensed Ohio dispensary, so there’s no way to shop with us in person. Everything we sell ships by mail to adults 21+.
