What changed in the Kansas medical marijuana program in 2026
Kansas still has no medical marijuana program. The 2026 session closed the 2025 to 2026 biennium, and two main medical bills, Senate Bill 294 and House Bill 2752, did not pass. Kansas is surrounded by states with broader access, including Missouri, Colorado and Oklahoma, which keeps the debate alive. This post explains what Kansas allows, what happened in 2026 and what residents should know. It is program and legal status information only, not legal or medical advice.
The legal picture in Kansas
| Item | Kansas status |
|---|---|
| Medical program | None |
| CBD | Allowed only with no THC under state law, with narrow exceptions |
| Home grow | Illegal |
| Adult use | Illegal |
| Hemp | Regulated by the Department of Agriculture |
| Neighbors | Missouri and Colorado have adult use, Oklahoma has a broad medical program |
Kansas has one of the strictest CBD laws in the country. State law has allowed CBD products only if they contain no THC, apart from a narrow defense created in 2019 under Claire and Lola’s Law and later expanded for certain parents of children with conditions.
The 2026 bills
SB 294 and HB 2752 would each have created a medical program, with differences in conditions, product forms and oversight. Neither passed both chambers. Since the 2026 session ended the biennium, both died. New bills must be filed in 2027.
Earlier attempts
The Kansas House passed a medical marijuana bill in 2021, but the Senate did not act. A Senate committee held hearings in later years, and interim committees studied the issue. Each time, Senate leaders declined to bring a bill to the floor. The governor has supported a medical program, but a bill must reach her desk first.
The federal piece
The DOJ final rule effective April 28 2026 placed marijuana under a state medical license in Schedule III, with a broader hearing that began June 29 2026. Kansas issues no state medical licenses, so the rule does not create access. Possession remains a crime under state law.
Hemp and Kansas consumers
The federal hemp changes take effect with the synthetic cannabinoid exclusion on Nov 12 2026 and THC and container limits plus a seed provision on Dec 11 2026. Because Kansas already restricts THC in CBD, many hemp products sold in other states are not legal in Kansas.
Crossing state lines
Missouri dispensaries are a short drive from Kansas City, Kansas. Buying there is legal in Missouri for adults 21 and older, but bringing products into Kansas is illegal under state law and federal law. Kansas law enforcement has made arrests at borders.
Penalties
First offense possession of marijuana is a misdemeanor with possible jail and fines. Repeat offenses and larger amounts carry felony exposure. Cultivation of several plants is a felony.

How the Kansas Legislature works
Kansas runs two year bienniums. Bills filed in the first year can carry over to the second, then die at the end. Committee chairs and leadership control what reaches the floor. That structure has let Senate leadership hold back medical bills even when the House has passed them.
Public opinion and stakeholders
Polls in Kansas have shown majority support for medical access, and veterans and patient groups have testified repeatedly. Law enforcement groups and some medical organizations have opposed bills or asked for tighter limits. The split has kept the debate going without a final vote.
What residents should do
Do not bring cannabis from other states into Kansas. Buy CBD only from sources that show the product meets Kansas law. Contact your state senator if you want a medical program, since the Senate has been the main barrier.
What to watch
Watch for new bills in the 2027 session, interim committee hearings and any changes to the CBD law. Our legal requirements for growing weed plants in your state compares other states.
What SB 294 and HB 2752 proposed
The bills differed, but versions included a list of qualifying conditions such as cancer, epilepsy, multiple sclerosis, Crohn’s disease, post traumatic stress disorder, chronic pain and terminal illness, a patient registry, licensed cultivators and dispensaries and limits on smoking. Oversight would have gone to a new office or an existing agency, depending on the version. These were proposals, and a 2027 bill could look different.
The 2019 CBD defense
Claire and Lola’s Law, effective July 1 2019, created an affirmative defense for a person with a debilitating condition, or the parent or guardian of a minor child with one, who possesses CBD oil with no more than 5 percent THC relative to CBD and a current physician letter. The defense is narrow. It does not authorize purchase in Kansas of products with THC, and it does not create a registry.

Hemp businesses
Kansas licenses hemp growers and processors through the Department of Agriculture, and licensed hemp is grown on many farms. State law limits which hemp products can be sold to consumers. The federal changes in late 2026 will apply on top of those rules, and Kansas hemp businesses should review both sets of limits.
Employers and testing
With no medical program, Kansas employers can test and discipline for any THC, including from products bought legally in other states. Commercial drivers and federal workers face federal rules. Residents should keep this in mind before using hemp products that may contain THC.
How to follow it
The Kansas Legislature website posts bill texts, committee schedules and votes. The 2027 session begins in January. Interim committees that meet in the fall of 2026 may preview what bills look like, so watch their agendas. Contact your senator and representative directly if you want to comment. Written testimony can be submitted to committees ahead of hearings, and Kansas committees often accept it from any resident, which is one of the easiest ways to be heard on a bill.
Program access, age and the law
This guide covers how the Kansas program works and who can access it. It does not describe what cannabis does for any condition, and it is not a substitute for a conversation with a licensed practitioner. Rules can change after a legislative session or a new agency rule, so confirm every detail with the Kansas Legislature and the Kansas Department of Agriculture before you act. Federal law still treats cannabis outside a state medical license as a controlled substance, and seeds have their own federal rules, so read our December 11 2026 seed rule explainer before ordering. Kind Seed Co sells only to adults 21 and older, and buying seeds is never a substitute for following the home grow rules in your state.
