What changed in the Pennsylvania medical marijuana program in 2026

What changed in the Pennsylvania medical marijuana program in 2026

2026 was a year of small changes and big debates for the Pennsylvania medical marijuana program. Patients saw a new payment system for their cards and steady fees, while lawmakers argued again over adult use and home growing without passing either. A federal order also changed how state licensed medical marijuana is classified. Here is a plain summary of what changed and what stayed the same as of late October 2026. It is policy background, not legal or medical advice.

At a glance

Area What happened in 2026
Card fee Stayed at $50 per 12 months
MMAP fee waiver Still covers Medicaid, PACE or PACENET, CHIP, SNAP and WIC enrollees
Payment system Moved to the Commonwealth Enterprise Payment Platform in June
Adult use Left out of the 2026 to 2027 budget
Home grow Patient bill SB 76 did not advance
Federal status State licensed medical marijuana placed in Schedule III in April

The new payment platform

In June 2026 the Department of Health moved registry payments to the Commonwealth Enterprise Payment Platform, the state’s shared system for online fees. For patients this means a new checkout screen when paying for a card or replacement. Saved payment details from the old system may not carry over. If a payment fails or shows twice, contact the registry help line before trying again.

Fees stayed the same

The patient and caregiver card fee is still $50 for each 12 month period. People enrolled in Medicaid, PACE or PACENET, CHIP, SNAP or WIC pay $0 through the Medical Marijuana Assistance Program. A first replacement card is $25. Physician certification visits are separate and set by each practice. Our Pennsylvania card guide walks through the full process.

Adult use stalled again

Governor Josh Shapiro again proposed legalizing adult use in his budget. The House had passed a state store model bill in 2025, but the Senate rejected it in committee. In 2026 the final 2026 to 2027 budget was enacted without legalization. Senate Bill 120, a bipartisan adult use proposal, did not get a floor vote. Pennsylvania remains a medical only state, surrounded by adult use states in New York, New Jersey, Delaware, Maryland and Ohio.

Home grow did not move

Senate Bill 76 would let registered patients grow a small number of plants. It did not advance from committee in 2026. We explain the law and penalties in our Pennsylvania home grow post.

The federal order

On April 28, 2026 the Justice Department ordered FDA approved cannabis products and state licensed medical marijuana into Schedule III. Other marijuana stays in Schedule I, and a DEA hearing on wider rescheduling is paused with briefing closing in November 2026.

Pennsylvania moved card payments to a new platform

What it means for Pennsylvania patients:

  • Program products. Products sold at licensed Pennsylvania dispensaries fall in the state licensed category.
  • Businesses. Licensed operators may see federal tax relief tied to Schedule III, which could affect prices over time.
  • Travel. Taking cannabis across state lines is still illegal.
  • Jobs and firearms. Federal guidance is still developing. Do not assume protections have changed. Our guide to workplace drug testing and cannabis legalization covers employer trends.

Program operations

Pennsylvania’s Department of Health continues to update regulations for growers, processors and dispensaries, including rules on product testing, labeling and dispensary operations. Many of these changes are invisible to patients but show up as new labels, product names or recalls. Check the Department of Health site for recall notices, and keep product packaging until you finish a product.

What patients should do now

  1. Check your card date. Renew early under the new payment system.
  2. Confirm MMAP eligibility. If you joined Medicaid, SNAP or another listed program this year, you may now qualify for a $0 card.
  3. Save your receipts. Keep confirmation emails from the new payment platform.
  4. Follow the legislature. Adult use and home grow may return in the 2027 budget talks.
  5. Do not grow. Cultivation is still illegal for patients.

Common questions at the dispensary counter

Pennsylvania dispensary staff report the same questions from patients this year. Did the fee go up? No. Can I pay with my old saved card? Possibly not, since the payment platform changed. Does Schedule III mean I can bring products to another state? No. Can I grow now? No. Having those answers ready saves time and avoids mistakes.

Caregivers

Caregiver rules did not change in 2026. Caregivers still register, pay the same fee unless MMAP applies and renew on the same cycle. Caregivers who pay for several patients should note that each payment now runs through the new platform separately.

Pennsylvania budget left out legalization

What to watch in 2027

Expect another round of budget negotiations in early 2027 that may include adult use. Any deal could change how the medical program works, including taxes, dispensary licensing and possibly home grow. The federal DEA process could also bring changes. We will update this post as things move. Until then, treat any social media claim that Pennsylvania has legalized adult use as false unless you see it on an official state site.

How Pennsylvania compares

Most of Pennsylvania’s neighbors now allow adults 21 and older to buy cannabis. Our roundup of the most recent states to legalize recreational marijuana shows how that map has changed, and our complete guide to medical marijuana explains how medical programs differ from state to state. Because cultivation is not legal in Pennsylvania, our Pennsylvania seeds page explains that seeds are sold there as souvenirs and for genetic preservation.

Grow legally and responsibly

Home cultivation is only legal in some states, and each state sets its own plant limits, locking rules and rules about whether plants can be visible from a public place. You must be 21 or older to buy seeds from Kind Seed Co, and you should grow only where your state and city allow it. Check your state rules in our guide to the legal requirements for growing weed plants in your state before you plant. Federal treatment of cannabis seeds is also changing, so read our December 11 2026 seed rule explainer before you order. Keep plants and harvested flower locked away from children, pets and visitors, and never drive after using cannabis. This article is general information. No. It is still $50 per 12 months and $0 for MMAP eligible patients. Only the payment platform changed.

Can Pennsylvania patients grow at home now?

No. SB 76 did not advance, so home grow is still illegal.

How does the federal Schedule III order affect Pennsylvania?

It reclassified state licensed medical marijuana at the federal level. Day to day patient rules in Pennsylvania did not change.

Final thoughts

For most Pennsylvania patients, 2026 brought a new payment screen and nothing else that changed daily life. Fees, MMAP and dispensary access stayed the same, and adult use and home grow are still on hold. Renew early, keep your receipts and watch the 2027 budget.
