Is weed legal in North Carolina in 2027
This article is general information, not legal advice. Laws change often, so check the current statutes and talk to a licensed North Carolina attorney about your situation. Kind Seed Co sells only to adults 21 and older.
No. As of October 29, 2026, weed is not legal in North Carolina for recreational or medical use under state law, and home growing is not allowed. No law has been enacted that would make cannabis legal in 2027. Possession is a crime under North Carolina’s Controlled Substances Act, with penalties that rise with the amount. The main exception is on the Qualla Boundary, where the Eastern Band of Cherokee Indians allows adult use sales under tribal law, but that does not change state law anywhere else in North Carolina. Lawmakers could act in the 2027 session, so check for updates before you rely on this. Our companion post on buying cannabis seeds in North Carolina covers seed rules in detail.
What North Carolina law says
Cannabis is regulated under North Carolina’s Controlled Substances Act in Chapter 90 of the General Statutes. Section 87 of Chapter 90 defines marijuana to include all parts of the cannabis plant, growing or not, its seeds and its resin, with exceptions for hemp, mature stalks and fiber, and sterilized seed that cannot germinate. Marijuana is a controlled substance under state law.
Possession penalties in North Carolina
Section 95 of Chapter 90 sets penalties for possession. In summary, as of October 29, 2026:
| Amount | General classification |
|---|---|
| Half an ounce or less | Class 3 misdemeanor |
| More than half an ounce up to one and a half ounces | Class 1 misdemeanor |
| More than one and a half ounces | Class I felony |
| Larger amounts | Trafficking charges with mandatory penalties |
These are general summaries. Actual charges depend on the facts, prior record and other laws. Sale, delivery, manufacture and possession with intent to sell carry separate, more serious penalties. Talk to a North Carolina attorney about any specific situation.
Is medical marijuana legal in North Carolina?
No. North Carolina has no medical marijuana program. Bills such as the Compassionate Care Act have passed the state Senate in past sessions but have not passed the House. A narrow hemp extract law allows certain patients with intractable epilepsy to use specific low THC hemp extracts, but that is not a medical marijuana program.
In 2026, the state Department of Health and Human Services Advisory Council on Cannabis released an interim report dated April 2, 2026. No law changing cannabis access had been enacted as of October 29, 2026.
Can you grow weed at home in North Carolina?
No. Growing cannabis is illegal under North Carolina law, and cultivation is treated as manufacturing a controlled substance. There is no home grow allowance for adults or patients. Licensed hemp farming is a separate regulated program and is not a path to growing THC cannabis.

If you are interested in home growing, read our overview of legal requirements for growing weed plants in your state to see which states allow it.
The Qualla Boundary
The Eastern Band of Cherokee Indians permits adult use cannabis sales to adults 21 and older on the Qualla Boundary under tribal law. It is a sovereign tribal system. Cannabis bought there remains illegal under North Carolina law once it leaves the Boundary, and federal law also applies. Do not carry cannabis off tribal land.
Hemp and hemp derived products
Hemp products are sold widely in North Carolina. Hemp is defined separately from marijuana by THC level. Federal law is changing on December 11, 2026, when a 2025 federal law, Public Law 119 37, takes effect for parts of the hemp definition at 7 U.S.C. 1639o. That change is expected to affect many hemp derived intoxicating products and viable seeds from drug type plants. Check current state and federal guidance before buying hemp products, since rules are moving.
Federal law
Marijuana remains illegal under federal law. Federal law applies everywhere, including on tribal land and in states that have legalized. Federal rescheduling discussions do not legalize cannabis on their own.

What could change in 2027
The North Carolina General Assembly meets in 2027. Lawmakers could take up medical cannabis or other bills, as they have in past sessions. Nothing is certain, and we do not predict outcomes. Watch for:
- Medical cannabis bills in the Senate and House
- Changes to hemp rules after the federal change
- Any reports from the state’s cannabis advisory council

Neighboring states
North Carolina borders Virginia, Tennessee, South Carolina and Georgia. Virginia allows adults to possess and grow cannabis at home under its own rules, while the others do not have adult use laws. Crossing state lines with cannabis is illegal, even from a state where it is legal, and bringing cannabis into North Carolina is a crime under state law. See the most recent states to legalize recreational marijuana.

Past convictions and record relief
North Carolina has expunction laws that may allow some people to clear certain past drug convictions or dismissed charges. Eligibility depends on the offense, the time that has passed and your full record. North Carolina has not passed an automatic cannabis expungement law. A North Carolina attorney or a legal aid group can tell you whether you qualify.
Driving and cannabis
Driving while impaired by any controlled substance, including cannabis, is illegal in North Carolina. Never drive after using cannabis, wherever you are.
Employment and cannabis
North Carolina employers may test for cannabis and act on positive results under their policies. Tribal sales or out of state legality do not protect you at work. See workplace drug testing and cannabis legalization.
