Not for recreational use. As of October 29, 2026, Pennsylvania allows medical marijuana for registered patients through licensed dispensaries, but adult use cannabis is still illegal, and home growing is not allowed for anyone. No law has been enacted that would legalize recreational cannabis in 2027. Lawmakers have debated legalization in recent sessions, and a House bill passed narrowly in 2025 before failing in a Senate committee. Check for updates before you rely on this. Our companion post on buying cannabis seeds in Pennsylvania covers seed rules in detail.

What Pennsylvania law says

Cannabis, called marihuana in the statute, is a controlled substance under Pennsylvania’s Controlled Substance, Drug, Device and Cosmetic Act. The definitions section of that act, 35 P.S. section 780 102, includes seeds in the definition. Possession, sale and cultivation outside the medical program are crimes under state law.

Possession penalties in Pennsylvania

In general, as of October 29, 2026:

Situation General classification
Small amount for personal use (30 grams or less of marijuana) Misdemeanor, with lower maximum penalties
More than the small amount Misdemeanor with higher maximum penalties
Possession with intent to deliver, sale or cultivation More serious charges, often felonies

Several cities, including Philadelphia and Pittsburgh, have local ordinances that treat small amounts as a civil violation with a fine. Those local rules do not change state law, and state police or prosecutors can still apply state charges. Talk to a Pennsylvania attorney about any specific case.

Is medical marijuana legal in Pennsylvania?

Yes. The Medical Marijuana Act, Act 16 of 2016, created a medical program run by the Pennsylvania Department of Health. Patients with a qualifying condition need a certification from a registered practitioner and a medical marijuana ID card, and they buy from licensed dispensaries. The law sets the allowed product forms and limits.

The medical program does not allow home growing. Patients must buy from licensed dispensaries. Medical status does not make it legal to grow, share or sell cannabis outside the program.

How patients join the medical program

The general process, as described by the Department of Health, looks like this:

Pennsylvania cannabis law
  1. Register with the state medical marijuana program online.
  2. Get certified by a practitioner registered with the program for a qualifying condition.
  3. Pay the card fee, unless you qualify for a fee reduction.
  4. Receive your ID card and buy only from licensed Pennsylvania dispensaries.

Check the Department of Health site for the current list of qualifying conditions and fees, since they can change.

Can you grow weed at home in Pennsylvania?

No. Home cultivation is illegal for both adults and medical patients as of October 29, 2026. Growing cannabis outside a licensed facility is treated as manufacturing a controlled substance. See legal requirements for growing weed plants in your state for a broader view of state rules.

The 2025 legalization debate

In May 2025, the Pennsylvania House passed House Bill 1200, which would have created an adult use system with sales through state stores, by a vote of 102 to 101. The bill then failed 3 to 7 in the Senate Law and Justice Committee. Other legalization proposals have been introduced in the Senate, but none had been enacted as of October 29, 2026.

Governors have included legalization proposals in budget plans, but a budget proposal is not law. Only a bill passed by both chambers and signed, or allowed to become law, changes the rules.

Hemp and hemp derived products

Hemp products are sold in Pennsylvania under separate rules. Federal law is changing on December 11, 2026, when a 2025 federal law, Public Law 119 37, takes effect for parts of the hemp definition at 7 U.S.C. 1639o. That change is expected to affect many hemp derived intoxicating products. Check current state and federal guidance before you buy.

Pennsylvania medical marijuana program

Federal law

Marijuana remains illegal under federal law, even for state medical patients. Medical patients in Pennsylvania should know that federal law can affect things like firearm ownership and federal employment.

Neighboring states

Pennsylvania borders New Jersey, New York, Maryland, Delaware and Ohio, which all allow adult use cannabis under their own laws. West Virginia has a medical program only. Bringing cannabis bought in another state into Pennsylvania is illegal under Pennsylvania and federal law, even if you bought it legally. See the most recent states to legalize recreational marijuana and the next states likely to legalize.

Driving and cannabis

Pennsylvania DUI law covers driving under the influence of controlled substances, and the law has been strict about cannabis in a driver’s blood. Medical patients should check the current rules carefully. Never drive after using cannabis.

Pennsylvania and neighboring state laws

Employment and cannabis

The Medical Marijuana Act includes some workplace protections for certified patients, but employers can still enforce rules against impairment and some safety sensitive jobs have exceptions. Adult use has no workplace protection because it is not legal. See workplace drug testing and cannabis legalization.

Past convictions and record relief

Pennsylvania has a Clean Slate law that can seal some older records automatically, and there have been pardon efforts for certain low level cannabis convictions. Eligibility depends on your record. A Pennsylvania attorney or legal aid group can tell you what applies to you.

What could change in 2027

The General Assembly can take up legalization at any time, including during budget talks. Nothing is certain and we do not predict outcomes. Watch for:

Pennsylvania cannabis questions
  • New adult use bills in the House and Senate
  • Budget proposals that include cannabis
  • Changes to the medical program
  • Changes to hemp rules after the federal change
