Is weed legal in Ohio now and what you can grow
This article is general information, not legal advice. Ohio’s cannabis law changed in 2026, so check the current Ohio Revised Code and the Division of Cannabis Control before you buy, carry or grow. Adult use is for people 21 and older only.
Yes. As of October 2026, cannabis is legal in Ohio for adults 21 and older. Adults can buy from licensed dispensaries, carry up to 2.5 ounces of cannabis plant material and up to 15 grams of extract, and grow up to six plants each at their primary residence, with a cap of twelve plants per home. Senate Bill 56, which took effect on March 20, 2026, kept legalization in place but tightened many rules. Here is what is legal, what is not and how home growing works.
A quick timeline
- November 7, 2023: Ohio voters approved Issue 2, legalizing adult use cannabis.
- December 7, 2023: Issue 2 took effect. Adults 21 and older could possess cannabis and grow at home.
- August 6, 2024: licensed adult use dispensary sales began.
- December 19, 2025: the governor signed Senate Bill 56.
- March 20, 2026: SB 56 took effect, moving the adult use rules into Ohio Revised Code Chapter 3796.

What adults 21 and older can do in Ohio
Buy from licensed dispensaries

Adults 21 and older can buy cannabis from dispensaries licensed by the Division of Cannabis Control. Purchase limits are set by law and rule and can change, so check the Division’s current guidance or ask the dispensary. SB 56 capped the number of licensed dispensaries statewide at 400.
Possess cannabis
Adults may possess up to 2.5 ounces of cannabis plant material and up to 15 grams of extract. Seeds, live plants and clones grown legally at home are not counted toward that limit.
Share without payment
Adults may transfer cannabis to other adults 21 and older within the possession limits as long as no money or other payment is involved. Selling without a license is illegal.
Grow at home
This is the part most Kind Seed Co readers care about. Under ORC 3796.04:
- Up to six plants per adult 21 and older.
- No more than twelve plants per residence.
- Only at your primary residence.
- In a secured closet, room, greenhouse or other enclosed area that keeps out anyone under 21.
- Not visible by normal unaided vision from a public space.
- Processing by manual or mechanical means only, with no hydrocarbon extraction.

What is still illegal in Ohio
- Anything under 21. Adult use is for 21 and older only.
- Public consumption. Using cannabis in public places is prohibited.
- Impaired driving. Driving under the influence of cannabis remains illegal.
- Open containers in vehicles. Under SB 56, cannabis in a vehicle should be in the trunk or behind the last row of seats.
- Bringing cannabis in from other states. SB 56 bars bringing cannabis into Ohio from out of state.
- Selling without a license, including homegrown cannabis.
- Exceeding limits. Under SB 56, going over possession or plant limits by any amount can bring penalties.
- Growing for someone else. You may not grow on behalf of another person.
Your employer and landlord still have a say
Legal does not mean allowed everywhere. Employers may keep drug free workplace policies, and landlords may prohibit growing or using cannabis on their property through the lease. Read your lease before you start a home grow.
Federal law is separate
Cannabis remains regulated under federal law, which is separate from Ohio law. Federal rules are also changing, so stay informed, especially if you work in a federally regulated job or live in federally subsidized housing.
How to start a legal home grow in Ohio
- Confirm eligibility. You are 21 or older, growing at your primary residence, and your lease (if you rent) allows it.
- Choose a secured space. A locked grow tent in a spare room, closet or basement is the easiest approach.
- Plan your count. Six per adult, twelve per home, including seedlings.
- Keep it private. No plants visible from the street or a public space.
- Control odor. An exhaust fan with a carbon filter keeps neighbors happy.
- Pick your seeds. Start with forgiving genetics.

Why so many Ohio articles are out of date
Ohio’s cannabis law has moved fast. Articles written in 2023 and 2024 often describe Issue 2 as it originally passed, before lawmakers rewrote it with SB 56. Some describe the old rule that penalties for extra plants applied only at large overages, or cite section numbers that have since moved to Chapter 3796. If you are reading anything about Ohio cannabis law, check the date and compare it with the current Ohio Revised Code and the Division of Cannabis Control.
Tips for staying on the right side of Ohio law
- Keep purchases and homegrown cannabis at home in a locked spot.
- Do not carry more than the possession limit, even for a short trip.
- Keep cannabis out of reach of anyone under 21.
- Save receipts from dispensary purchases.
- Recheck the rules every year, because Ohio may keep adjusting them.
