Texas cannabis law changes to watch in 2027
Texas has no adult use cannabis program and no home grow. Even so, it has seen some of the biggest cannabis related changes in the country over the past year, almost all of them in the hemp market. Hemp products with intoxicating cannabinoids were sold widely for years. State and federal actions in 2025 and 2026 have sharply narrowed that market. This post breaks down the changes by topic and what to watch when the Legislature returns in January 2027. It is general information for adults 21 and older, not legal advice.
Hemp: age limits and THCA
In September 2025, Governor Abbott issued Executive Order GA-56. It directed state agencies to require buyers of consumable hemp products to be 21 or older and to count THCA toward total THC when testing products. Many THCA flower products that were sold as hemp no longer qualify.
Hemp: delta 8 scheduling
State action to schedule delta 8 THC took effect July 31, 2026. Products that rely on delta 8 are no longer legal to sell in Texas as hemp.
Federal hemp redefinition
Congress changed the federal definition of hemp in a 2025 law, and a later law adjusted the effective dates. The new definition looks at total THC and limits intoxicating hemp products. Parts took effect on November 12, 2026, and the main provisions take effect December 11, 2026. Together with state action, this means the Texas hemp shelf in 2027 will look very different from 2024.
Home growing
Growing cannabis at home is illegal in Texas. Cultivating any amount of marijuana is treated as possession, and penalties depend on weight. There is no exception for medical patients. Hemp cultivation requires a state license and testing.
Possession
Possession of up to two ounces of marijuana is a Class B misdemeanor under state law, with potential jail time and fines. Several cities passed local ordinances to deprioritize low level cases, but the state has challenged those ordinances in court. Do not rely on a local ordinance for protection.
The Compassionate Use Program
Texas runs a limited medical program, the Texas Compassionate Use Program. It allows low THC cannabis for patients with qualifying conditions, prescribed by registered physicians. Lawmakers expanded the program in 2025. It does not allow home growing. Questions about eligibility belong with a registered physician.

What to watch in the 2027 session
| Topic | What could happen |
|---|---|
| Hemp | A state law that writes GA-56 and federal changes into statute, or loosens them |
| Possession | Bills to reduce penalties for small amounts, which have passed the House before |
| Medical | Further changes to the Compassionate Use Program |
| Local ordinances | Court rulings on city decriminalization measures |
| Adult use | Bills will be filed, but passage is unlikely in the near term |
What this means for gardeners
For Texans interested in cultivation, there is no legal path to grow cannabis at home in 2027. Seeds are sold online as collectibles in many states, but that does not create permission to germinate them in Texas. Common Texas myths
“THCA flower is still hemp.” Under GA-56, THCA counts toward total THC, which disqualifies most THCA flower.
“My city decriminalized it.” Several city ordinances have been challenged by the state. State law still applies.
“A medical card from another state protects me.” Texas does not honor out of state cards. Only registered Compassionate Use Program patients are protected, and only for low THC products.
“Seeds are legal, so growing is legal.” Seeds may be sold as collectibles, but growing cannabis in Texas is illegal.
Where to check for updates
The Texas Legislature Online site lists bill text and status. The Department of State Health Services posts hemp rules. The Department of Public Safety runs the Compassionate Use Registry. Check these sources before relying on news stories.
Traveling
Do not bring cannabis into Texas from New Mexico or any other legal state. Federal law also bans carrying it across state lines.
How the Texas Legislature works
Texas lawmakers meet in regular session only in odd numbered years, starting in January and running about 140 days. That means 2027 is a session year, and most cannabis and hemp bills will be filed, debated and either passed or killed between January and late May. The governor can call special sessions, and recent years have seen hemp issues raised in special sessions too. A bill that passes still needs the governor’s signature or must survive a veto window before it becomes law.

For anyone following cannabis policy, the practical calendar looks like this. Bills get filed in the months before session. Committee hearings start in February and March. Floor votes cluster in April and May. Effective dates are often September 1 of that year, but each bill sets its own.
Proposals versus law
Expect plenty of headlines in 2027 about expanding the Texas Compassionate Use Program, adjusting hemp rules or changing penalties. Until a bill is signed and effective, it is only a proposal. City level decriminalization ordinances have also faced legal challenges from the state, so do not rely on a local ordinance as protection. Home cultivation remains illegal in Texas regardless of any pending bill.

Grow legally and responsibly
Home cultivation is only legal in some states, and each state sets its own plant limits, locking rules and rules about whether plants can be visible from a public place. You must be 21 or older to buy seeds from Kind Seed Co, and you should grow only where your state and city allow it. Check your state rules in our guide to the legal requirements for growing weed plants in your state before you plant. Federal treatment of cannabis seeds is also changing, so read our December 11 2026 seed rule explainer before you order. Keep plants and harvested flower locked away from children, pets and visitors, and never drive after using cannabis. This article is general information about gardening. It is not legal advice and it is not medical advice.
