Illinois cannabis home grow rules for 2027
Illinois legalized adult use cannabis sales in 2020, yet home growing is one of the most misunderstood parts of the law. Many visitors and new residents assume that because they can buy cannabis at a dispensary, they can also grow a few plants in a closet. They cannot. Heading into 2027, Illinois remains one of the few legal sales states where only registered medical patients may grow at home. This guide explains who can grow, how much, under what conditions and what bills could change that. It is general information for adults 21 and older, not legal advice.
The short answer
If you are an adult in Illinois without a medical cannabis registry card, growing any number of cannabis plants at home is illegal under state law. Penalties depend on the number of plants. Five or fewer plants is a civil violation for non patients under the Cannabis Regulation and Tax Act, with larger counts treated more seriously under the Cannabis Control Act. Either way, it is not a gray area.
Who can grow: registered medical patients
Illinois residents who are registered qualifying patients in the state Medical Cannabis Patient Program, and who are 21 or older, may grow up to five plants that are taller than five inches per household. Key conditions include:
- Household cap. The limit is five plants per household, regardless of how many patients live there.
- Enclosed and locked. Plants must be in an enclosed, locked space.
- Not visible. Plants cannot be in plain view from a public place.
- Owner permission. Renters need the property owner’s permission, and landlords can prohibit cultivation.
- Reasonable precautions. The grower must take steps to keep plants away from anyone under 21.
Plants under five inches are not counted toward the five plant cap, which matters for seedlings, but clones that pass five inches count immediately.
Possession limits for everyone else
| Who | Flower | Concentrate | Infused products |
|---|---|---|---|
| Illinois resident 21+ | 30 grams | 5 grams | 500 mg THC |
| Visitor 21+ | 15 grams | 2.5 grams | 250 mg THC |
These limits are cumulative in some readings, so mixing product types does not multiply your allowance. Medical patients may have different purchase allowances through the program.
What happens with your harvest as a patient
Medical patients who grow may keep the cannabis produced by their plants at their residence, provided it is secured. Selling or trading any of it is illegal. Sharing with another patient can raise questions, so check program guidance before you give anything away.
Why Illinois still bans home grow
When lawmakers wrote the 2019 act, home grow was a negotiation point. Supporters of a strong licensed market argued that limiting home cultivation would support tax revenue and social equity licensees. Medical patients kept the right to grow as a compromise. Since then, advocates have filed bills almost every session to allow adults to grow a few plants.

Bills to watch in 2027
Lawmakers have filed bills over the years that would allow adults 21 and older to grow a small number of plants at home, but none had become law as of late 2026. Some separate proposals deal only with the medical program, such as raising the patient plant cap per dwelling, and would not legalize adult home grow. Similar bills are likely to return in the 2027 spring session. Until a bill passes both chambers and is signed, the current rules stay in force. Track bill status on the Illinois General Assembly website rather than relying on social media posts.
Renters and condo owners
Even medical patients face real limits in rentals. A landlord can refuse permission, and condo associations can restrict odor and electrical use. If you are a patient, ask in writing and keep the response. A small, sealed grow cabinet with a carbon filter is easier to approve than a full room.
Setting up a compliant patient grow
Illinois patients often grow indoors because of the state’s cold winters and humid summers. A lockable tent or cabinet with a carbon filter keeps the grow private and limits odor in apartments. Our complete grow tent setup guide walks through lights, fans and filters. With only five plants allowed, many patients train plants to fill the space with low stress training rather than adding plant count.
Can I buy seeds in Illinois?
Seeds are sold online and in some places in Illinois, but buying seeds does not create a right to grow them. Non patients who buy seeds can legally keep them only as collectibles under state law. Federal rules for seeds are also changing, which we explain in the seed rule explainer linked below. Our Illinois seed page is written for registered patients and collectors.
Common Illinois myths
“Buying seeds means I can grow.” Seeds can be purchased in many places, but in Illinois only registered medical patients may cultivate. An adult without a patient card who germinates seeds is growing illegally.

“Five plants per patient means five per adult in the house.” The five plant cap applies per household, no matter how many patients live there.
“Nobody enforces it.” Home cultivation by people who are not patients is a civil or criminal violation depending on plant count. Do not assume a local department will look the other way.
“The pending bill already passed.” No adult home grow bill had become law as of late 2026. Check the General Assembly site before planting.

Grow legally and responsibly
Home cultivation is only legal in some states, and each state sets its own plant limits, locking rules and rules about whether plants can be visible from a public place. You must be 21 or older to buy seeds from Kind Seed Co, and you should grow only where your state and city allow it. Check your state rules in our guide to the legal requirements for growing weed plants in your state before you plant. Federal treatment of cannabis seeds is also changing, so read our December 11 2026 seed rule explainer before you order. Keep plants and harvested flower locked away from children, pets and visitors, and never drive after using cannabis. This article is general information about gardening.
