Virginia cannabis home grow rules for 2027

Virginia cannabis home grow rules for 2027

Virginia lets adults grow cannabis at home, and 2027 is a big year for the state because licensed retail sales are set to begin on July 1, 2027. Home grow rules did not get looser in the process. They are the same four plants per household, with one unusual detail that many growers miss: every plant needs a tag. This guide explains the rules, the penalties and how to stay compliant. It is general information for adults 21 and older, not legal advice.

Four plants per household

A person 21 or older may grow up to four cannabis plants for personal use at their main place of residence. A household can never contain more than four plants at once, regardless of how many adults live there. A household means everyone living in the same home, related or not.

The plant tag rule

Virginia requires each plant to have a legible tag with:

  • The grower’s name.
  • Their driver’s license or ID number.
  • A note that the plant is being grown for personal use as authorized by law.

The Cannabis Control Authority offers a downloadable plant tag template. Use waterproof labels and attach them to the main stem or a stake in the pot so they survive watering and weather.

Visibility and access

Plants cannot be visible from a public way without aircraft, binoculars or other optical aids. Growers must take precautions to prevent access by anyone under 21. Missing a tag or letting plants be visible can bring a civil penalty of up to $25. That is small, but it can draw attention to other issues.

Penalties for growing too many plants

Plants Penalty under current law
5 to 10 $250 civil penalty first offense, misdemeanors after
11 to 49 Class 1 misdemeanor
50 to 100 Class 6 felony
More than 100 Felony with up to 10 years

Counting matters. A fifth seedling sitting in a cup can technically put you over.

Possession and sharing

Adults can possess cannabis in their private residence and carry up to two ounces in public under the current Cannabis Control Authority guidance. Adult sharing is allowed under current guidance: you may give two ounces or less to another adult 21 or older as long as nothing else of value changes hands. Bundling a “free gift” with a paid item is illegal.

Renters and landlords

Landlords may prohibit cultivation and smoking on their property. Read your lease and get any permission in writing.

Retail sales arrive in 2027

House Bill 30 created a licensed retail market with sales starting July 1, 2027. The CCA plans to accept license applications starting February 1, 2027. This changes where adults can buy, but it does not change home grow limits. Seeds and clones may become available through licensed channels once the market opens, depending on the regulations the CCA adopts.

Growing in Virginia’s climate

Virginia ranges from humid Tidewater lowlands to cooler mountain valleys. Outdoor growers face humidity and late summer storms, which raise mold risk. Choose mold resistant cannabis strains and plan harvest timing with our guide on when to harvest outdoor cannabis. Indoor growers can use a locked tent with a carbon filter. With only four plants, low stress training helps each one fill its space.

A compliance routine

  1. Print or write tags before you germinate.
  2. Tag each seedling as soon as it is potted.
  3. Keep no more than four plants in the household at any time.
  4. Keep plants out of public view and away from minors.
  5. Store harvested cannabis in a locked container.

Making plant tags that last

Weather and watering can ruin paper tags. Use waterproof plant labels, garden stakes with paint pens or printed tags sealed in clear tape. Attach tags so they cannot slip off when branches move. For outdoor plants, check tags after storms. Keep a spare set in a drawer so you can replace a faded tag quickly.

Odor and neighbors

Virginia does not set a numeric odor limit for home grows, but local nuisance rules and lease terms can apply. Townhouse and apartment growers should use a carbon filter on an exhaust fan. Outdoor growers should keep plants away from shared fences and walkways.

Moving to a new home

The law ties home grow to your main residence. If you move, plants should move with you to the new main residence, stay within the four plant cap and remain tagged. Do not leave plants at the old address.

From the Blue Ridge to Hampton Roads

Virginia’s growing season changes a lot from west to east. The Shenandoah Valley and southwest mountains bring cooler nights and frost that can arrive in early October. Richmond and Northern Virginia sit in the middle, while Hampton Roads and the coastal plain get the longest, most humid season. Coastal growers fight mold and caterpillars in September, so frequent bud checks pay off.

If you grow outdoors, remember that plants must not be visible from a public way and must be protected from people under 21. A fenced backyard with screening plants or a greenhouse with frosted panels can meet both goals. Many Virginians simply grow indoors, where tags stay dry and readable and the household count is easy to track. Our germination guide covers how to start seeds indoors before any move outside.

Grow legally and responsibly

Home cultivation is only legal in some states, and each state sets its own plant limits, locking rules and rules about whether plants can be visible from a public place. You must be 21 or older to buy seeds from Kind Seed Co, and you should grow only where your state and city allow it. Check your state rules in our guide to the legal requirements for growing weed plants in your state before you plant. Federal treatment of cannabis seeds is also changing, so read our December 11 2026 seed rule explainer before you order. Keep plants and harvested flower locked away from children, pets and visitors, and never drive after using cannabis. This article is general information about gardening. It is not legal advice and it is not medical advice.
