Delaware cannabis home grow rules for 2027

Delaware cannabis home grow rules for 2027

Delaware legalized adult use cannabis in 2023, and licensed sales started in 2025. Many residents assume that legal possession means legal growing. In Delaware it does not. As of late 2026, adults cannot grow cannabis at home, and neither can medical patients. This guide explains what is legal, what is not, how the penalties work and what would need to change for home grow to arrive. It is general information for adults 21 and older, not legal advice.

What Delaware legalized

House Bill 1 made it legal for adults 21 and older to possess, use and share small amounts of cannabis. House Bill 2 set up a licensed and regulated market, overseen by the Office of the Marijuana Commissioner, with licensed growers, manufacturers, testing labs and retailers. Neither bill created a home grow right.

Activity Adults 21+ in 2026
Possess up to 1 ounce of flower Legal
Share up to 1 ounce with an adult without payment Legal
Buy from a licensed retailer Legal
Grow at home Not legal
Sell without a license Not legal

Why home grow was left out

During debate, lawmakers raised concerns about diversion to the illicit market, enforcement costs and protecting the new licensed market while it got started. Advocates pushed for a small plant count similar to neighboring states. The compromise was a sales only model, at least for now.

Medical patients

Delaware’s medical marijuana program has run since 2011. Patients buy from licensed compassion centers. Patients are not allowed to grow at home either.

Penalties for growing

Growing without a license is still treated as illegal cultivation. Penalties depend on the amount and circumstances, and they are more serious than for simple possession. Even a single plant can create legal risk. Do not plant in Delaware until the law changes.

Seeds

Cannabis seeds are sold online as collectibles in many parts of the country. Buying seeds is not the same as having permission to grow, and Delaware does not provide a legal path for adults to germinate them. Collectors should store seeds cool, dark and dry, which our guide on how to germinate cannabis seeds covers before you ever need to plant.

What would need to change

For home grow to become legal, the General Assembly would need to pass a bill that amends state cannabis law and sets a plant count, location rules and penalties. Bills of this kind have been discussed. Watch the session that starts in January 2027, and check the Office of the Marijuana Commissioner website for any update.

If a bill passes, expect rules similar to nearby states: a small plant count per household, plants out of public view, locked spaces and no sales.

Preparing without planting

If you hope to grow once the law allows it, you can learn now without breaking the law:

Traveling to neighboring states

Maryland and New Jersey border Delaware. Maryland allows a small home grow. New Jersey does not allow home grow for adults. Do not carry cannabis across state lines. Transporting cannabis between states is a federal crime even when both states have legal markets.

Common Delaware myths

“Possession is legal, so a plant or two is fine.” Possession and cultivation are separate. Delaware allows the first and not the second.

“Patients can grow.” The medical program does not include home cultivation.

“Seeds are illegal to own.” Seeds are sold as collectibles in many places. The issue is germination and growing, which Delaware does not allow.

“A bill passed last session.” Home grow proposals have been discussed, but none had become law as of late 2026.

How a home grow bill would likely look

If lawmakers move on home grow, expect a cap similar to nearby states, such as two to four plants per household, a locked space requirement, landlord opt outs and a delayed start date. Penalties for going over would also be set. Do not plant until a law is signed and in effect.

Where to check for updates

The General Assembly website lists bill text and status. The Office of the Marijuana Commissioner posts updates on the licensed market. Check both before relying on news stories.

Delaware’s growing climate, for when the law changes

If home grow arrives, Delaware gardeners will work with a long, humid season. New Castle County in the north has slightly cooler springs, while Kent and Sussex counties toward the beaches warm earlier and stay muggy deep into September. Coastal moisture and heavy dew make mold and bud rot the main threats for outdoor flowering plants. Caterpillars and stink bugs are common in late summer across the Delmarva Peninsula.

That climate rewards preparation. Learning to read soil moisture, prune for airflow and scout for pests on tomatoes or peppers now will carry over directly. Reading guides on how to germinate cannabis seeds and when to harvest outdoor cannabis is legal and costs nothing.

What Delaware adults can do today

Adults 21 and older can buy from licensed retailers and possess within state limits. They can learn, plan and keep seeds only where state and federal law allow it. They cannot germinate seeds, grow plants or keep clones. Anyone who wants to grow should follow the General Assembly for home cultivation bills and avoid relying on social media summaries.

Key takeaways

  • Adults can possess up to one ounce and buy from licensed stores.
  • Home growing is not allowed for adults or medical patients.
  • Unlicensed cultivation remains a crime.
  • Watch the 2027 General Assembly for home grow bills.

Grow legally and responsibly

Home cultivation is only legal in some states, and each state sets its own plant limits, locking rules and rules about whether plants can be visible from a public place. You must be 21 or older to buy seeds from Kind Seed Co, and you should grow only where your state and city allow it. Check your state rules in our guide to the legal requirements for growing weed plants in your state before you plant. Federal treatment of cannabis seeds is also changing, so read our December 11 2026 seed rule explainer before you order. Keep plants and harvested flower locked away from children, pets and visitors, and never drive after using cannabis. This article is general information about gardening.
