Delaware cannabis law changes to watch in 2027

Delaware cannabis law changes to watch in 2027

Delaware’s adult use cannabis law is still young. The General Assembly passed legalization in 2023, and licensed retail sales began in 2025. Since then, lawmakers and regulators have kept adjusting the rules. Here is where things stand and what to watch as 2027 begins.

The basics today

Topic Current rule
Age 21 and older
Possession Up to 1 ounce of flower, 12 grams of concentrate, or products with up to 750 mg of THC
Home grow Not allowed for adults or medical patients
Public use Not allowed
Regulator Office of the Marijuana Commissioner
Sales Licensed retailers only

Recent changes from the 2026 session

The 2026 legislative session produced several cannabis bills. Details matter, so read the enacted text on the General Assembly website.

Enforcement

HB 411, signed on September 16 2026, renamed the state enforcement agency the Division of Alcohol, Tobacco, and Marijuana Enforcement. It is a name change only and does not create a new enforcement program.

Business spacing

HB 271 dealt with spacing rules for licensed cannabis businesses, which affects where stores and other licensees can locate. Local zoning still plays a large role.

Medical program

SB 226, signed in May 2026, made changes to the medical program. Patients should check the Office of the Marijuana Commissioner for how the changes affect registration and access.

Local control after veto override

SB 75 limits how counties can restrict marijuana establishments. The governor vetoed it in 2025, then the General Assembly overrode the veto on July 1 2026 and the bill became law that day. Counties must now follow statewide rules on conversion retailers, minimum store hours, indoor cultivation in agricultural or industrial zones, and how close retail stores can sit to each other and to schools, child care, parks and similar places.

Hemp

HB 395, a hemp bill, passed one chamber but did not become law in 2026. Hemp derived intoxicating products remain an active topic, especially with federal changes on the way.

Federal hemp changes

Federal law is changing on two dates that matter to Delaware. On November 12 2026, synthetic cannabinoids are excluded from the federal hemp definition. On December 11 2026, new limits on THC per container and the provisions affecting seeds take effect. Delaware lawmakers may respond with their own hemp rules in 2027. Home grow is still off the table

Delaware remains one of the few adult use states with no home cultivation at all. Advocates have pushed to add it since legalization, arguing that adults in neighboring Maryland can grow a small number of plants. No bill allowing home grow has passed. Watch for new proposals in the 2027 session, but do not grow until a law is enacted and in effect.

Issues to watch in 2027

License expansion

The state set a limited number of licenses at the start. Lawmakers may consider whether to add more, especially in counties with few stores.

Local zoning

Some towns and counties have limited where cannabis businesses can open. With SB 75 now law after the July 1 2026 veto override, counties face tighter statewide limits on how far those local rules can go, while municipalities still work under separate statutes.

Social equity

Delaware’s law includes social equity licenses. Expect continued debate on how well the program is working.

Taxes

Adult use sales carry a state tax. Lawmakers may revisit how revenue is spent.

Expungement

Delaware has made progress on clearing past cannabis records. Further changes could expand eligibility.

The 2027 calendar

The General Assembly typically convenes in January and ends its session on June 30. Most cannabis bills, if any pass, will move in spring. Bills signed in summer often take effect weeks or months later, so check effective dates.

How to follow the changes

  • The Delaware General Assembly website lists bills, votes and enacted text
  • The Office of the Marijuana Commissioner posts rules, FAQs and licensing news
  • Local news covers committee hearings and floor votes

What this means for consumers

Buy only from licensed retailers. Keep within possession limits. Do not use cannabis in public or while driving. Remember that home grow is still illegal, and that hemp rules may shift after the federal changes in late 2026.

What it means for future growers

If you hope to grow at home someday, watch the 2027 session closely. In the meantime, you can learn gardening skills with legal plants. When the law changes, our guides on how to germinate cannabis seeds and best soil for growing marijuana outdoors will help you get started.

Why Delaware chose a slow approach

Lawmakers designed the 2023 law to start a small, regulated market first, leaving home grow aside. Supporters of that approach say it protects licensed businesses as they get started. Critics say it leaves adults with no low cost legal option. Expect both arguments to return whenever home grow comes up again.

Neighboring states as context

Delaware sits between states with very different approaches. Maryland allows adults to grow two plants per household. New Jersey, like Delaware, bans home grow. Pennsylvania allows medical use only. That patchwork shapes the debate in Dover, since many Delaware residents work or shop across state lines. Taking cannabis across any state line remains illegal under federal law, even between two legal states, so buy and use within Delaware.

Reading a bill without getting lost

When you look up a cannabis bill, start with the synopsis, then check the final version, since amendments often change the original text. Look for the effective date near the end. Note whether the governor signed it, let it become law or vetoed it. If a bill passed only one chamber, it is not law. These simple checks help separate real changes from proposals that never finished.

Grow legally and responsibly

Home cultivation is only legal in some states, and each state sets its own plant limits, locking rules and rules about whether plants can be visible from a public place. You must be 21 or older to buy seeds from Kind Seed Co, and you should grow only where your state and city allow it. Check your state rules in our guide to the legal requirements for growing weed plants in your state before you plant. Federal treatment of cannabis seeds is also changing, so read our December 11 2026 seed rule explainer before you order. Keep plants and harvested flower locked away from children, pets and visitors, and never drive after using cannabis. This article is general information. It is not legal advice and it is not medical advice.
