District of Columbia cannabis home grow rules for 2027

District of Columbia cannabis home grow rules for 2027

Washington, DC, is a special case in cannabis law. Voters approved Initiative 71 in 2014, which made it legal for adults 21 and older to possess, grow and gift small amounts of cannabis. Because Congress oversees the District’s budget, a long running federal rider has blocked DC from setting up a taxed and regulated adult use market. That leaves home grow as one of the main legal ways for adults to get cannabis outside the medical program.

The rules at a glance

Rule DC adult use
Age 21 and older
Plants per adult Up to 6, with no more than 3 mature
Plants per household Up to 12, with no more than 6 mature
Location Inside the interior of your principal residence
Possession Up to 2 ounces
Gifting Up to 1 ounce to another adult, with no payment
Sales Not allowed outside the licensed medical program

Plant counts

Each adult may grow up to six plants, but only three can be mature at once. The household limit is 12 plants, with no more than six mature, no matter how many adults live there. A household of three adults cannot grow 18 plants. The cap is 12.

Where you can grow

Plants must be grown inside the interior of your principal residence. That rules out yards, rooftops, open balconies and community gardens. A spare room, closet or grow tent inside your home is the usual setup. Our complete grow tent setup guide walks through a compact grow space that fits an apartment or rowhouse.

Federal land is different

About a fifth of the District is federal land, including the National Mall, many parks and federal buildings. Federal law applies there, and possession is illegal on federal property even with DC’s law. Public housing that receives federal funding may also ban cannabis. If you live in federally assisted housing, read your lease carefully.

Renters

Landlords in DC may set lease rules about cannabis. Read your lease and ask before setting up a grow. Odor and humidity from a grow can also cause disputes in shared buildings, so plan ventilation carefully. A carbon filter is the standard tool. See our guide to the DIY carbon filter build.

Gifting, not selling

DC law lets adults give up to one ounce to another adult 21 or older, as long as nothing is exchanged. For years, some businesses offered a free gift with the purchase of another item. The DC Council passed laws in recent years to crack down on that model and bring more sellers into the licensed medical system. Home growers should never sell any part of their harvest, and should not trade it for goods or services.

DC plants must be inside the residence

The medical program

DC’s medical program is run by the Alcoholic Beverage and Cannabis Administration. Adults 21 and older can self certify as medical patients under current rules, which lets them buy from licensed medical retailers. Rules change, so check the agency site. The medical program does not change home grow limits.

Using cannabis

Public consumption is illegal in DC. Use is generally allowed only on private property, and landlords or property owners can ban it. Never drive after using cannabis.

What to watch in 2027

The federal budget rider is the biggest factor. Each year, Congress decides whether to keep blocking DC from regulating adult use sales. If the rider changed, the Council could build an adult use market. Home grow rules could also change through local legislation. Federal hemp law changes on December 11 2026, which may affect how seeds are sold. Read our December 11 2026 seed rule explainer.

Growing in a city home

Light

Most DC homes have limited window light. An efficient LED keeps plants healthy without the heat of older lamps.

Space

Rowhouses and apartments often have small rooms. A two by four foot tent can hold three plants comfortably. Plan for height, since cannabis can stretch during flowering.

Humidity

DC summers are hot and humid, which can raise humidity in a grow space. A small dehumidifier helps, especially in late flowering when mold risk rises.

Noise

Fans and filters make noise. Choose quiet models and use rubber mounts if you share walls with neighbors.

Getting started

Confirm you are 21 or older, that your lease allows growing, and that you are not on federal property or in federally restricted housing. Set up an interior grow space, start a few seeds with our guide on how to germinate cannabis seeds, and keep count of mature and immature plants.

Federal land follows federal law

Common mistakes

  • Treating the 6 plant limit as unlimited per household
  • Growing on a balcony, roof deck or in a yard
  • Bringing cannabis onto federal land
  • Selling or trading homegrown cannabis
  • Ignoring lease rules in shared buildings

Storage and harvest

A single DC grow can produce more than the 2 ounce possession limit. Homegrown cannabis kept at the place where it was grown is generally treated differently from what you carry, but the rules can be confusing, so keep harvests modest and stored at home in a locked container. Dry flower in a cool, dark room and cure it in sealed jars. Our guides on cannabis drying temperature and humidity guide and guide to burping jars explain the process. Never carry more than 2 ounces outside your home, and keep it out of sight in a sealed container when traveling within the District.

Grow legally and responsibly

Home cultivation is only legal in some states, and each state sets its own plant limits, locking rules and rules about whether plants can be visible from a public place. You must be 21 or older to buy seeds from Kind Seed Co, and you should grow only where your state and city allow it. Check your state rules in our guide to the legal requirements for growing weed plants in your state before you plant. Federal treatment of cannabis seeds is also changing, so read our December 11 2026 seed rule explainer before you order. Keep plants and harvested flower locked away from children, pets and visitors, and never drive after using cannabis. This article is general information.
