Maryland cannabis law changes to watch in 2027
Maryland moved from medical only to a full adult use market faster than most states. Voters approved legalization in November 2022, and licensed adult use sales started on July 1 2023 under the Maryland Cannabis Administration, known as the MCA. Since then, the General Assembly has adjusted the program every year. The 2026 session was no exception, and several of its changes set up deadlines that land in 2027. This guide covers what passed, what did not and what Maryland residents should watch next.
Snapshot of Maryland rules as 2027 approaches
| Area | Rule today |
|---|---|
| Legal age | 21 and older |
| Personal use amount | 1.5 ounces of flower, 12 grams of concentrate or 750 mg of THC in products |
| Home cultivation | Two plants per residence for adults, regardless of how many adults live there |
| Regulator | Maryland Cannabis Administration |
| Where to buy | Licensed dispensaries only |
| Retail sales tax | 12 percent since July 1 2025 |
What the 2026 session actually passed
Two cannabis bills that change day to day business became law in 2026. Both took effect on July 1 2026.
HB 622, Chapter 375
This MCA request bill made several practical changes:
- Micro dispensaries may now employ up to 20 people, up from 10, and those workers are registered cannabis agents
- The old Responsible Vendor Training is now called Cannabis Agent Training
- Agents must complete the training within 90 days of starting work and then every two years, instead of every year
- The MCA now sets the core curriculum by regulation instead of by statute
- Dispensaries that converted from the original medical program can keep delivering medical cannabis to patients through June 30 2027
SB 594, Chapter 416
This bill focused on advertising and licensing:
- Cannabis advertising may not directly target people under 21
- Standard dispensaries get clearer rules for exterior signs, with a size cap of 900 square inches per sign and 1,200 square inches in total
- Signs may now share business contact details, safety contacts and similar notices
- The ownership and control share required of a social equity applicant changed
- The MCA must accept audience composition data for ads and adopt rules on it by January 1 2027
What did not pass
HB 1519, nicknamed the Cannabis Reform and Opportunity Act, would have rewritten rules on management service agreements, advertising and penalties. It received a hearing in the House but did not advance to become law. Ideas in it may return in 2027.
No bill to raise the adult home grow limit passed in 2026. Adults remain limited to two plants per residence.
Dates to circle in 2027
January 1 2027
The MCA deadline for adopting audience composition rules under SB 594 falls on this date. Expect final regulations, or at least a notice of proposed action, around the turn of the year. Licensees who advertise should track the Maryland Register.
January 2027
The General Assembly meets for 90 days each year, starting on the second Wednesday in January. In 2027 that should be January 13, which puts the end of session in mid April. Any new cannabis bill would most likely pass in March or April and take effect on July 1 or October 1.
June 30 2027
Medical delivery authority for converted dispensaries runs through this date under HB 622. Lawmakers could extend it again, make it permanent or let it lapse. Patients who rely on delivery should watch for a bill in the 2027 session.
Home grow in Maryland, unchanged for now
Maryland’s home grow law sits in the Criminal Law article of the state code. It sets a limit of two plants per person and no more than two per residence when two or more adults live there. Plants may not be in public view, and that includes a view from someone else’s private property without binoculars, aircraft or other optical aids. Growers must take reasonable precautions, such as an enclosed, locked space that no one under 21 can open. Growing must take place on property you lawfully possess or with permission of the person who does. Breaking these rules is a misdemeanor that can carry up to three years in jail, a fine of up to 5,000 dollars or both.

Medical patients have a separate, higher home grow allowance. In its most recent patient survey, the MCA reported that patients asked for the medical limit to rise from four plants to six. That is a request, not a law, but it signals a debate that could surface in 2027. Our deeper guide to Maryland home grow rules for 2027 covers the details.
Hemp and federal changes
Maryland already folded many intoxicating hemp products into its licensed market when the adult use program launched in 2023. Federal changes add another layer. On November 12 2026, synthetic cannabinoids leave the federal hemp definition. On December 11 2026, new limits on THC per container and new federal seed rules take effect. Maryland lawmakers may update state hemp language in response. Read our December 11 2026 seed rule explainer.
Issues likely to come up in 2027
Advertising enforcement
With SB 594 in force and audience rules due, the MCA will start applying the new advertising standards. Expect guidance documents, warning letters and questions from licensees about social media and billboards.
Delivery
The June 30 2027 cutoff for medical delivery by converted dispensaries makes delivery a likely topic. Advocates for patients with limited mobility will push to keep it.
Social equity licensing
Maryland has run multiple social equity licensing rounds. The ownership change in SB 594 shows lawmakers are still adjusting the rules, and more changes could follow.
Tax revenue
The 2025 increase in the retail sales tax drew criticism from the industry. Budget pressure could keep the rate in place, or lawmakers could revisit it.
Home grow limits
Patient interest in a higher medical plant count makes home grow a possible 2027 bill topic. Adult limits are less likely to move soon, but watch for introduced bills in January.
How to follow along
- The Maryland General Assembly site lists every bill, hearing and vote, and posts fiscal and policy notes that explain bills in plain language
- The MCA posts regulations, guidance and stakeholder event notices
- The Maryland Register publishes proposed and final regulations

What Maryland residents can do now
If you grow at home, stay within two plants per residence, keep them locked and out of view, and keep records of where your seeds came from. If you are a patient, confirm your certification and delivery options before June 2027. If you run or work at a dispensary, plan for Cannabis Agent Training within 90 days of hire and review signage against the new limits. For growing basics, our guides on how to germinate cannabis seeds and best soil for growing marijuana outdoors are good places to start.
Grow legally and responsibly
Home cultivation is only legal in some states, and each state sets its own plant limits, locking rules and rules about whether plants can be visible from a public place. You must be 21 or older to buy seeds from Kind Seed Co, and you should grow only where your state and city allow it. Check your state rules in our guide to the legal requirements for growing weed plants in your state before you plant. Federal treatment of cannabis seeds is also changing, so read our December 11 2026 seed rule explainer before you order. Keep plants and harvested flower locked away from children, pets and visitors, and never drive after using cannabis. This article is general information. It is not legal advice and it is not medical advice.

Final thoughts
Maryland’s 2026 changes were practical rather than dramatic: more staff for micro dispensaries, new training rules, tighter advertising standards and a one year extension of medical delivery. The 2027 calendar has three dates to watch: the January 1 advertising rule deadline, the January session start and the June 30 end of delivery authority. Home grow limits stay the same for now. Check the General Assembly and MCA sites before you act on any change.
