New Jersey cannabis law changes to watch in 2027
New Jersey spent much of 2026 rewriting its hemp rules, while the question most home gardeners care about, whether adults can grow their own, stayed stuck in committee. With a new governor in office and a two year legislative session that runs into early 2028, 2027 could be the year one of those debates moves. Here is a plain language look at where New Jersey law stands and what to keep an eye on.
How New Jersey got here
Voters approved adult use cannabis at the ballot in November 2020. Lawmakers then passed the Cannabis Regulatory, Enforcement Assistance, and Marketplace Modernization Act, signed in February 2021. Licensed adult use sales began on April 21 2022. The Cannabis Regulatory Commission, or CRC, licenses businesses and writes the rules. Adults 21 and older may possess up to six ounces. Growing at home, however, was left out entirely, and it remains a crime for everyone, including registered medical patients.
The big 2026 story was hemp
Three laws signed across two governors reshaped how New Jersey treats hemp products.
| Law | Signed | What it did |
|---|---|---|
| P.L.2025, c.215 | January 12 2026, Gov. Murphy | Created a framework for intoxicating hemp products and repealed the 2024 hemp law |
| P.L.2026, c.7 | March 30 2026, Gov. Sherrill | Revised sale restrictions on hemp products and beverages through November 2026 |
| P.L.2026, c.13 (A5051) | May 29 2026, Gov. Sherrill | Revised hemp, hemp beverage and medical cannabis provisions |
New definitions from April 13 2026
From April 13 2026, several things no longer count as hemp under New Jersey law and are treated as cannabis instead:
- Products with more than 0.4 milligrams of total THC per container
- Cannabinoids that the plant cannot produce naturally
- Cannabinoids the plant can produce but that were made by chemical synthesis
- Viable seeds from cannabis plants above the hemp THC limit
That last point matters to anyone thinking about seeds. Read the CRC guidance closely and follow current state law before buying or carrying seeds in New Jersey.
Sales restrictions
The new laws ban online sales of hemp derived cannabinoid products and intoxicating hemp beverages, ban beverage sales from vending machines and ban selling any product with detectable THC to anyone under 21. From May 31 2026, a hemp beverage could hold no more than 5 milligrams of THC per serving and 10 milligrams per container, and had to be lab tested.
The November 13 2026 switch
After November 13 2026, any hemp beverage over 0.4 milligrams of total THC per container is treated as cannabis. That means it must be made by a licensed Class 2 cannabis manufacturer and sold only by a licensed Class 5 cannabis retailer. Corner stores and liquor stores that carried THC drinks will need to stop. Expect 2027 to bring enforcement actions, CRC rules and possibly cleanup bills.
Federal hemp dates on top of state law
Federal law adds its own deadlines. Synthetic cannabinoids leave the federal hemp definition on November 12 2026, one day before the state beverage switch. New federal limits on THC per container and new federal seed rules take effect on December 11 2026. New Jersey’s rules already sit close to the federal line, but both layers apply. Our December 11 2026 seed rule explainer covers the seed side.
Home grow: two bills, no movement yet
Two main home cultivation proposals were introduced on January 13 2026, the first day of the 2026 to 2027 session.

S2564, adult and medical home grow
Sponsored by Senators Vin Gopal and Troy Singleton, S2564 would let adults 21 and older grow up to six plants, with a household cap of 12. Registered patients and caregivers 21 and older could grow up to 10 plants for medical use, also within a 12 plant household cap. The CRC would have 90 days to write rules. The bill sits in the Senate Judiciary Committee.
S1758 and A1674, medical home grow only
This narrower proposal would let a registered patient or designated caregiver grow up to four mature and four immature plants. It sits in the Senate Health, Human Services and Senior Citizens Committee and the Assembly Oversight, Reform and Federal Relations Committee.
The politics
Governor Mikie Sherrill said during her 2025 campaign that she supported home cultivation with limits and safeguards. In September 2026, patient and home grow advocacy groups publicly asked her to push legislative leaders for a hearing. As of late October 2026, neither bill had cleared a committee. Because New Jersey bills stay alive for the full two year session, both could still move in 2027 without being reintroduced.
Five things to watch in 2027
- A committee hearing on S2564 or S1758. A hearing is the first real sign of movement.
- CRC rules for hemp. The CRC has issued interim FAQ guidance and is expected to adopt formal regulations.
- Enforcement after November 13 2026. Watch for actions against unlicensed hemp beverage sellers.
- Municipal decisions. Towns that opted out of some license types can opt back in, and local votes shape where stores open.
- Federal rescheduling. Federal changes could affect banking, taxes and research, though they would not legalize home grow in New Jersey.
What has not changed
- Adults 21 and older can buy from licensed dispensaries and possess up to six ounces
- Public consumption is not allowed outside permitted lounges where towns allow them
- Driving after using cannabis is illegal
- Growing cannabis at home is still a crime for adults and patients
Practical advice for New Jersey residents
If you are interested in gardening, learn with legal plants now. If home grow becomes legal, you will already know how to manage soil, water and light. Do not plant cannabis until a law is passed, signed and in effect, and until the CRC explains how it will work. When that day comes, our guides on how to germinate cannabis seeds and complete grow tent setup guide can help.
If you sell or carry hemp products, read the CRC hemp FAQ and talk to a lawyer about the November 13 2026 changes.

Grow legally and responsibly
Home cultivation is only legal in some states, and each state sets its own plant limits, locking rules and rules about whether plants can be visible from a public place. You must be 21 or older to buy seeds from Kind Seed Co, and you should grow only where your state and city allow it. Check your state rules in our guide to the legal requirements for growing weed plants in your state before you plant. Federal treatment of cannabis seeds is also changing, so read our December 11 2026 seed rule explainer before you order. Keep plants and harvested flower locked away from children, pets and visitors, and never drive after using cannabis. This article is general information. It is not legal advice and it is not medical advice.

Final thoughts
New Jersey’s cannabis story in 2026 was about hemp, with three laws and a November 13 deadline that moves intoxicating hemp drinks into the licensed market. Home grow remains illegal, and the bills that would change that are waiting in committee with the clock running until early 2028.
